Ethical Theories Essay

Moral dilemmas are a part of daily life and the solutions presented to them are usually dependent on the ethics that govern the individual facing them. Every person at one point in time has been faced with a moral dilemma. This can be described as the values which are used to determine the right way to handle a situation and the wrong way to go about it. Each society and community has its own moral index and in some societies, an action may be viewed tolerable or right, while the same action in another community would be viewed as intolerable and frowned upon. The moral index of a society usually goes hand in hand with religious beliefs and communities which are religiously inclined to have strict rules on what is suitable behaviour and what is not. Societies which have more secular values usually tolerate extreme or eccentric behavior. The difference in opinions of different people in what is normally right and wrong has led to the development of various ethical theories. Two of these theories are utilitarianism and duty ethics. An example of a situation which brought about different ethical stand points is the Firestone Company tire recall in 1999 and 2000. The company had discovered that its newly designed firestorm Radial ATX, ATX II and Wilderness AT tires were defective back in 1996, after 8 of the 18 times were singled out after they failed a test that tested the endurance of tires under high speed. Of the 14. 4 million tires sold approximately 6. 5 million tires had to be recalled due to defects in the details which involved the tread and one steel belt separating from the other steel belt and carcass The details has led to serious and even fatal accidents as the cars overturned when the accidents occurred while they were in motion. In an attempt to show difference between utilitarianism and duty ethics we shall consider an engineer working for the company at the time and the stand he or she would take if they subscribed to utilitarianism or duty ethics Utilitarianism can be described as an ethical theory that proposes that the action that brings good or favorable consequences to the majority is not subject to whether it is right or wrong meaning it is not subject to questioning. (Fredrick,2003) This theory was greatly championed by utilitarians such as John Stuart Mill. This theory advocates for actions that produce happiness to the greatest or largest number of people. In an ideal situation this may be possible but usually any action can produce happiness to many or a few people depending on the action. The theory does not usually advocate for the use of ethically correct actions at all times and thus actions which may be viewed as wrong sometimes bring happiness to a large group of people but the actions still remain morally wrong. An engineer subscribing to the utilitarianism way to life would have supported the company stand and the action it took. The company discovered that some tires were defective and did not recall the rest of the tires that had already been sold. This lead to accidents which caused suffering and death and it was not until an investigation into the cause of the accidents that finally forced the Firestone Company to admit liability and recall the tires. The company did not recall the tires because it feared the losses that it would face incase the tires were all defective. The company chose to protect their profits margins at the expense of their clients. (Little, 2003) As an engineer with a utilitarianism view point this action would be the best because recalling would mean great losses and downsizing in terms of job which would mean unemployment for many people working at the company affecting both them and their dependants. The duty ethics proposes that the action taken in any situation should be just and honest and respectful to all persons involved. This ethical principle advances for the upholding of principles regardless to the wrong consequences whether they will be good or bad. (Graham,2004) An engineer working for the Firestone Company would have chosen to recall all the defective tires and conducted a through investigation to the causes of the defaults without external pressure or the threat of law suits as inducement. The engineer moral compass would have guided them to make such a stand regardless to the fallout which is this case would have resulted in major losses to the company. As per the requirements of the engineering profession, this mechanical engineer was ascribed to some basic fundamental ethics and the relevant professional codes of conduct while in the jurisdiction of their duty. These are guidelines aimed at providing safety standards for the engineers while at work and the common good of the society. However, the same was objectively inadequate in the Firestone’s case. As a basic requirement, they should exercise their professional skills and also knowledge in providing contentment in the general human life. Impartiality and honesty should prevail in their service where fidelity to the public should never be compromised above that of clients and also employers. Elsewhere, engineers should pursue a continued development in their profession and bring service to their different clients without any conflict. These are the basic fundamentals of mechanical engineers whose proficiency is provided by the support of the canons of mechanical engineering. In conclusion the moral stand point taken by any individual should always be after requiring all the necessary information. This is because in every decision made, there are always individuals who love and those who benefit. As in the Firestone, the recalling decision would have resulted in loss. After careful evaluation one should decide on the decision that brings minimal losses in the involved activity.

To What Extent Was Cavour the Architect of the Italian Unification?

To what extent is it fair to refer to Cavour as the architect of the Italian Unification? After the failures of the 1848 revolution, Count Camillo Benso Di Cavour stepped in as the Prime Minister of Piedmont as the state was considered to be agitation concentration for those who still aimed and fought for the independence and unison of Italy. His liberal leadership philosophies enabled him to contribute in the movement towards the Italian Unification. However, is it fair to consider him an Italian Nationalist who always worked with his eyes on a unitary state?Cavour certainly aimed to get rid of Austrian interference in Italy so that Piedmont would grow into the Italian leading state. To accomplish this goal, he had to modernize Piedmont and extend its influence. Yet, he was aware that success would only be achieved by gaining foreign aid as Piedmont itself lacked strength to fight Austria alone. An opportunity to ally and get support from other nations rose during the Crimean War. P iedmont took the French and British sides on a war against Russia, which got defeated in 1856.As well as gaining the sympathy of France and Britain, Piedmont got the chance to attend the Paris Peace Conference where Cavour had the opportunity to share his intentions on ending with all Austrian domination over Italy. Although his plans were not much acclaimed, he did establish friendly relations with the French Emperor, Napoleon III. The two men met at Plombieres on July 20th and an agreement was made stating that if Austria attacked Piedmont, France would send in troops to help the fighting in return for the lands of Nice and Savoy.According to the historian Mac Smith, â€Å"Britain however, mistrusted Cavour and never planned war against Russia†. But still, with the French support, Cavour now tempted Austria into war, and when an ultimatum was issued, he rejected it declaring war. Austria was defeated provoking turbulences and commotions throughout Italy. Napoleon, however, was surprised by the rate at which events were moving and concluded an armistice with Austria causing Cavour to resign, as without France, Piedmont had to hope to grow.Still, the revolutionary movements in Italy while Cavour was still in power had motivated people from Tuscany, Parma, Modena and parts of the Papal States who were calling for annexation to Piedmont. Cavour came straight back to power in 1860 offering Napoleon the states of Nice and Savoy in return for the states of Central Italy. Some historians agree that at this point Cavour even hindered the Unification process as by giving Italian states away to France he was breaking down territorial integrity.Napoleon held a plebiscite and a devastating number of voters wished for the unification to the Piedmontese-Sardinian Kingdom. At this point, Cavour had reached all he aimed for. Piedmont was now a strong constitutional monarchy, which acted as a leader over the other Italian Sates. Through war, Cavour aimed to gain nation al glory only and his idea of foreign assistance never had the intention to help Italy achieve unification, it only meant to empower Piedmont. He was able to initiate the economic transformation of the state, enlarge the merchant fleet, treble foreign trade and develop the railway network.Cavour also established a political partnership, the Cannubio, in which he was able to resist pressure from the clerical right and the revolutionary left as he had his own centre-right party and Ratzzi’s centre-left group. This indicates that he that he focused on methods to modernize and develop Piedmont, and only Piedmont. He was satisfied with what he had achieved and had no intention to expand his kingdom into the southern states. He thought that by joining Naples and Sicily he would be taking the unification idea too further away and that it would provoke foreign opposition. The historian D.Beales says, â€Å"Cavour never talked of Unification but Piedmontese Domination† and LCB Seaman agrees when he states: â€Å"All that can be safely said is that Cavour wanted to get as much as could reasonably be obtained (for Piedmont), but no more†. Later in 1860, a new Italian figure appears. Giuseppe Garibaldi, an Italian Patriot, who had been a republican under the power of Giuseppe Mazzini in 1831, steps in. He had always been very determined about uniting Italy and had spent his entire life fighting for Austrian expulsion off Italy. A contrasting figure, with its ambitions set very clear, when compared to Cavour.Garibaldi was passionate for his country and wanted to make it all into one. When a revolution broke out it Sicily, he saw the opportunity to assist it. He soon took over the capital and prepared to attack the mainland. Garibaldi entered through Messina, struck north for Naples and made plans to enter Rome. Cavour immediately sent troops south in order to prevent Garibaldi from entering Rome, as it could be a great threat to incite war with France. The fact that Cavour did not support Garibaldi’s views and aims suggests that he undoubtedly did not want the whole unification of Italy.Cavour had no sympathy for Garibaldi, as he believed he was taking the idea of unification to another level and even ordered his arrest. Cavour made it very clear that he concentrated on the affairs of Northern Italy only and did not want the Southern part to join in. The Southern Italian states, however, demanded to unify with Piedmont and Cavour held a plebiscite. A massive majority was in favour of annexation to Piedmont and Garibaldi was forced to hand in over Sicily and Naples to Victor Emmanuel II who was than proclaimed King of Italy. Later in 1870, a plebiscite was held at Rome, which was also united to Italy.The Italian Unification was never under Cavour’s policy. The fact that the Italians aimed to unify altogether made them want to unify with Piedmont beforehand as they saw it as the first step to Unification. Cavourâ€⠄¢s intention to simply achieve Piedmontization failed due to the favourable factors that made the Italian Unification so successful. It is evident that Cavour was not the architect of the Italian Unification as he even tried to hinder the process. If he had not tried to stop Garibaldi in 1860 when he tried invading Rome, the unification process might had been completed before 1870.The historian LCB Seaman says that â€Å"For him (Cavour) the idea was tainted with radicalism, and his diplomat’s sense of realities told him there were too many insurmountable obstacles in the way†. Cavour did however, to a certain extent, enable the Italian Unification, as he was the one who began fighting for it (eventhough for him it only meant Piedmontese unification). He opened the door for Garibaldi. Without him, Garibaldi would have not been able to take over Sicily and move to the mainland so easily.Cavour was able to do what Mazzini couldn’t, he was able to reach every Ital ian and motivate them with the idea of unification. However, his intentions of unifications were very limited and the people of Italy wanted more than what he proposed. When Garibaldi stepped in, he knew he had massive support as a result of what Cavour had originally suggested. We can, therefore, say that Cavour enabled and contributed to the Italian Unification, but it would a falsity to refer to him as the Architect of the Italian Unification as he made it very clear that his intentions were never to reach this point.

The resistance can be covert i. e. implicit or overt/explicit. Classification of resistance to change can be classified to organization resistance or individual resistance (Toyne Nigh, 1999). Individual resistance to changes in the business environment can occur since the individuals perceive it to be a threat to their economic conditions, security and habit. On the other hand organization resistance to changes may occur because of group inertia, structural inertia, control of resources, expertise, fear of loosing power etc (Gholipour, 2007). To overcome these resistances to changes, the leaders can educate employees, go for negotiation, co-optation, coercion, manipulation and ensure that workers are involved in decision making process. For example the management can use Lewin’s three step model to manage the planned changes (Jain Tandan, 2006). Lewin’s three step approaches suggest that business organizations can develop permanent changes in the behaviors of the employees by making them unlearn the old working procedures and behaviors (Gholipour, 2007). On the other hand modern organizations place emphases on innovation and how they can learn to cope with the changes in business environment in order to stay ahead of competition (Toyne Nigh, 1999). Sources of innovations may include acquisition of new knowledge that leads to changes of perception and awareness, change of market and industrial structures, demographic changes etc. usiness organizations require to be committed in innovation and change and also change their cultures and structure in order to facilitate continuous learning of the employees. This proposal reviews literature in relation to the causes as well as effects on obesity specifically targeted at children between the ages of 6 – 18 years old and evaluates current programs in place to curb the rise in obesity. Programs from both the United States as well as Singapore are used to analyse the western and Asian perspectives on tackling the issue of obesity. The proposed program would be aimed at reducing social stigma and increasing self-esteem that past or current programs do not address. The program will be made up of three phases which include implementation, motivation and feedback as well as evaluation of the entire program’s effectiveness. Feasibility and efficacy of instilling the program are also discussed. Recent years has seen a rise in the levels of obesity especially in western nations but is currently seen to be a growing issue even in Asian nations (Ramachandran Snehalatha, 2010). Based on recent findings by Ogden, Carroll, Kit and Flegal (2014) an estimated two third of the adult population in the United States are overweight or obese with about one third of school going children also falling under this category. A growing trend is also seen in Asia where findings in Singapore indicate that approximately one in nine Singaporean adults between the age ranges of 18 to 69 were considered to be obese in 2010 with obesity rates said to be increasing at an estimated 1 percent per year (â€Å"One in nine Singaporean†, 2014). Multiple factors have been suggested as causes to obesity, often focusing on mainly physical and psychological factors. General physical causes of obesity are often due to genetic factors that cause abnormalities in fat cell metabolism and metabolic defects or simply having a sedentary lifestyle (Bray, York DeLany, 1992). There are also various psychological conditions or disorders that have been suggested to lead to obesity however depression is considered to be the main cause of it as evidenced in Blaine’s (2008) study which indicated that individuals who were depressed were proven to be at significantly higher risk of becoming obese. Obesity is also often comorbid with depression and other eating disorders Blaine’s (2008). The key area of concern especially in recent times would be the effects of obesity on the individual as well as society as a whole. Numerous studies have been done to show the physical and psychological effects that obesity has on an individual. Physical aspects often include the risk of contracting illnesses such as heart disease, hypertension, and diabetes (Sturm, 2002). Psychological effects tend to focus on an individual’s body dissatisfaction and self-image (Wardle Cooke, 2005) as well as well as psychosocial effects such as negative experiences through weight bias at home, in school, at work, through the media and even health and fitness areas (Amianto, Lavagnino, Abbate-Daga Fassino, 2011). Evaluation on Obesity Related Programmes Over the years there have been many programs put into place by governments and private agencies around the world that have been aimed to curb obesity. One key program introduced in the United States was the HEROES Initiative which targets tackling issues on childhood obesity (King et. al, 2014). The HEROES Initiative is a grant-funded intervention that targets schools to play a vital role in educating youth in obesity related behaviours (King et. al, 2014). The key aims of this this initiative would be to take a comprehensive school health approach that decreases childhood obesity that in turn promotes healthy lifestyle habits among students as well as their families and also the school staff (King et. al, 2014). Key features that make the intervention unique would be that it offers a supportive means for participating schools by providing regular oversight, significant funding and various implementation strategies that are catered to a particular needs for certain schools depending on the district and neighbourhood that they are located in (King et. al, 2014). This initiative also enables schools to have a sense of ownership over assessing the needs of their students and in turn coming out with a plan to implement certain strategies for changes in the school’s health programs (King et. al, 2014). The key feature in maintaining the effectiveness of this program would be the strong emphasis on an annual cycle of evaluation and assessment on opportunities in enhancing the program to cater to the needs of the students which turn increases the intervention’s efficacy (King et. al, 2014). The evaluation process was broken down into 3 main areas. The process evaluation stage, school level outcome evaluation and student level outcome evaluation (King et. al, 2014). The process evaluation stage is carried out by site visits to schools to view their administrative processes in carrying out health promotion as well as inspection of the school’s general environment and conducting interviews with the staff to determine challenging areas (King et. al, 2014). Feedback on information obtained is given to the staff as a means to address these issues (King et. al, 2014). In the school level outcome evaluation, assessments are made to the systemic changes in promoting healthy behaviour and reducing obesity rates in the students. The school level outcome evaluation is based on domains relating to physical education/activity, nutrition education, food service, staff wellness, as well as family and community involvement (King et. al, 2014). The student level outcome evaluation , focuses on understanding the changes in behaviour and knowledge in relation to obesity and its effects (King et. al, 2014). This done through weight measurements as well as surveys and quizzes to identify student’s knowledge about obesity (King et. al, 2014). With regard to the effectiveness of this initiative, evaluation between the periods of 2011-2012 showed a significant amount of variability between schools. Based on results obtained from the process and school level evaluation outcomes, it was found that the school’s processes were well implemented however some schools found difficulties in coming up with new or improved health and wellness related policies (King et. al, 2014). Based on the student level outcome evaluation it was found that small but significant changes were made in terms of behaviour and mindset of the students (King et. al, 2014). Students were also more engaged in rigorous physical activities in comparison to the baseline from first 18 months of the intervention (King et. al, 2014). However a set back to the intervention was that changes to behaviour were mostly found in overweight students rather than students who were already obese. In relation to the Asian context, there have been various health related programs and promotions carried out in Singapore. The Singapore health promotion board has come up with various programs and initiatives to promote healthy lifestyle practices to prevent conditions such as obesity. Programs such as the 1 million kg challenge, aims to encourage individuals to lose weight by allowing them to set a weight loss target then setting a period for them to lose this weight. If individuals are able to lose the amount of weight within the given time frame they are rewarded with certain incentives and prizes (â€Å"1 million kg challenge†, 2014). In relation to health promotion in schools, a key program that was introduced in the early 90s was the National Physical Fitness Award Test (NAPFA) and the TAF (Trim and Fit) scheme which aimed to increase physical activity and reduce the weight of overweight and obese students in both the primary and secondary levels of education (Gupta et. al, 2010). The TAF program basically tasked students with physical activities before and after the school day (Gupta et. al, 2010). The initiative was a success in the 90s with obesity levels dropping between 10-17% in students (Gupta et. al, 2010). Success of the TAF scheme would later bring about a collaboration between the Singapore Health Promotion Board and the World Health Organisation to introduce a HPB-MOE bi-annual award aimed at targeting the healthy development of students and awarding schools for good health practices (Gupta et. al, 2010). Challenges faced in the TAF program as well as similar programs introduced in Korea as mentioned by Shin and Shin (2008) was that such programs bring about a sort of negative stigma to students involved. Student then tend to become highly self-conscious and develop body dissatisfaction which in turn effects their self-esteem (Shin Shin, 2008). This is often the result of segregation from their peers due to their weight and appearance and this segregation is further contributed by schools who single out overweight or obese individuals to be part of such programs (Shin Shin, 2008). This effect could in turn lead to depression which has been established as a cause for obesity and would hence defeat the whole purpose of having such health promotion programs. Proposed Health Program Having identified the causes and effects of obesity as well as certain health programs available both on the western and Asian context along with their strengths and weaknesses, an alternative health program could be developed. Through analysing the health programs available in both the United States and Singapore, a program catering specifically to the needs of students between the ages of 6 – 18 year olds could be proposed. The program will be entitled the â€Å"Fitness for Fulfilment Programme† (FFFP) catered specifically in the Singaporean context. The program is also given a name that does not infer or refer to obesity so as to prevent any form of social stigma relating to obesity. The main goals of the program would be to reduce the weight of overweight and obese students but to do so in a manner that will not cause stigmatization or embarrassment. The program would also further aim to instil a healthy mindset in these students and encourage them to maintain healt hy behaviour well into adulthood. The FFFP will mainly be broken down into three key phases. The first phase will be the implementation phase which will introduce rigorous exercise specifically catered to losing weight for obese children. These exercises will be done during school hours as part of an enhanced physical education program and these obese students will carry out their activities together with other students so as to limit any sense of being ostracised. The enhanced physical education program will target the specific needs of each student be it normal weight students or overweight or obese students by focusing on their weak physical areas that are limiting them from passing or getting a good grade on their NAPFA test. The fitness program will be one that gradually increases in rigorousness so as to allow the students time to condition themselves to its requirements. Another key feature of the implementation phase would be the enforcement of strict diet practices during the school day. Since schools are al ready given guidelines by the Health Promotion Board on the type of food to be served, there must be a form of enforcement that ensures that students are getting the appropriate meals. Therefore there should be two to three staff on canteen duty to ensure that proper meals are being served to the students and that obese children are getting sufficient food but maintained at healthy levels. The second phase of the FFFP would the feedback and motivation phase. This would be a key feature of the program as it caters to the psychological well-being of the students involved. This phase will be implemented during the first and last session of the enhanced physical education program. During these sessions, time will be set aside for instructors to carry out one on one interviews or feedback sessions with the students which will aim to understand the challenges that they face with physical exercise as well as issues they have with motivating themselves to indulge in physical exercise. With knowledge of the challenges that individual students face, instructors can cater their physical education session to better accommodate to both the strengths and the weaknesses of the students. This will facilitate a more positive outlook in carrying out physical exercise and encourage students to put in a greater effort and hence may lead better physical results and lower obesity levels. An other aspect of this phase would be educating other students in the challenges that overweight and obese students. Students will be taught to encourage and motivate rather than stigmatize or humiliate their overweight or obese peers. The final phase of this program will be the evaluation phase. Ideally a review council should be formed to evaluate the effectiveness of the program at national level. This phase will be similar to the HEROES initiative evaluation process used in the United States, but will comprise of two instead of three key parts of the evaluation process of the effectiveness of the program. The process and school level evaluation will be combined into one. This part of the evaluation process will seek to understand the challenges that the staff have with the FFFP through means of interviews as well as on site assessments of the program in action. Availability of proper equipment and exercise facilities in the school will be key points at this level of evaluation. The next part of the evaluation will be at the student level, the review council will assess data relating to changes in weight as well as NAPFA standards and also find out the level of knowledge that students have with regard to healthy behaviour through surveys and quizzes which can be done through the internet. The evaluation process should be done annually and aim to identify problem areas so that newer and improved implementation could be introduced in the following years. The feasibility and efficacy of the FFFP would depend on the amount support through funding from private agencies or the government as well as having instructors who are trained in not only physical aspects of exercise and healthy lifestyle but also with the psychological capability to deal and understand the needs and challenges for individual students to overcome obesity. Personal Narrative: Teaching Students to Enjoy Writing Essay -- Free Es

Writing is something that always came relatively easy to me. I was not the best student in High School, though that was primarily due to my lack of effort and enthusiasm. I was certainly capable of doing the work, though baseball and Atari always seemed to come first. But with writing, I was most often able to produce the quality of work my parents expected of me in a short and painless amount of time. As I set such a scenario for you, two problems are clearly recognizable. The first lies in the lack of effort I put forth in my early schooling, and the second is that I recognized very early what my parents expectations of me were, though I failed to explore my own subdued expectations. They were bubbling just beneath the surface of my false faà §ade of a student. It was not until my years in college, and my subsequent experience, although it is still in its infant stages, of teaching High School English that I began to appreciate writing and reading as a useful tool rather than a mechanism for keeping a smile on my parents’ faces. When this released enthusiasm became part of my life, the latter of the scenario’s problems quickly solved the former. He was a professor at SUNY Cortland, Ross Borden. And it was only by a twist of fate that my path was fortunate enough to cross with his. As I signed up for Early British Literature as an undergraduate, I expected simply to carry on with my typical style of enduring English, for my major was in the sciences. I had known from the time I graduated from High School that I was probably most apt to succeed in English, though my personal restraints pushed me away from it. Nonetheless, as I walked through the door to Early British Literature, I had expected a woman professor, as my schedule... ...everal times the same word, definition, or phrase because he or she had acted inappropriately or missed a question. While the punishment is perhaps effective for some teachers, it instills in the student the ideology that writing is a punishment. Thus the student will continue this attitude until someone, like Ross Borden, is effective enough to change it. While the difficulties in teaching students not only to be good writers, but also to enjoy writing are easy to complain about, they are not immediately changeable. Consequently, as a teacher of young writers, one must find a way to make the system work. Ross Borden found a way with me, and I feel I have found a way with many of my students, but not all of them. So I continue to read, and I continue to write, and I continue to teach, though I also continue to struggle with the many problems surrounding the field.

The Appalachian Trail :: essays research papers

When I was in the seventh grade, our class went on a field trip to Cherokee, North Carolina. The trip lasted four days and three nights, but the adventure would last a lifetime. The experience allowed me to learn many things about myself and to reflect on the beauty that was all around me. We departed at six-thirty in the morning, and I was so excited. I had never been away on a school trip for longer than a few hours. I tossed my purple duffel bag into the storage compartment, found my seat by the window, and prepared for what I knew would surely be an unforgettable adventure. When we finally arrived in the mountains, it was breathtaking. They were covered with trees, and the clouds floating over them were so beautiful. I looked down and saw valleys of flowers that went on forever. I was so anxious to get off the bus and roll in the grass with the clear, blue sky above my head. The bus came to a halt, and one by one we filed out into a parking lot. We grabbed our canteens and began the one-mile trail to the top of one of the mountains. I was one of the first people to reach the peak, and waiting for us was a notebook. We opened it to find the names of everyone who has ever reached the peak. I smiled to myself as I wrote in big letters â€Å"Kim Walton† and started back down the mountain. It was much easier and faster than going up, and everyone was really excited to see where we were going next. When we arrived at the Best Western, everyone grabbed his/her suitcases, quickly tucking them into the rooms as the candy shop across the street drew us in like moths to a flame. Afterwards, we went back to our rooms, put on our bathing suits, and went for a late-night swim under the stars. It was so cold, but we did not mind it because we were having so much fun. Later we went back to our rooms and went to sleep. Our next day would surely be packed with action and adventure. The next morning, we went to Alpine Tower: a seventy-five feet high vertical structure that is designed to help you work with others and test your physical strength as well as your bravery, motivation, and problem-solving strategies. Equipped with helmets, harnesses, and ropes, we took our places around the tower and prepared for the first person to go up. Learning Team Reflection Essay

With the advancement of technology and the rise in Internet usage amongst individual companies, businesses, and organizations, they are faced with new challenges in protecting their brand, trademark, and image from competitors (Clark, 2007). This has caused many businesses to take action in the protection of intellection property rights or IPR. For the week three assignment, the members of team A choose to discuss the case in which Premier Technologies wins intellectual property lawsuit. This paper would highlight details of the case. Doug Sayer, the owner of Premier Technologies, claimed that two of his former employees stole private information for trade secret infringement and future sabotage. The former men were members of top management at Premier Technologies. Orr and Schutte, the two men, downloaded the organizations insider information to external hard drivers, and shortly after that, left the organization to work for the competitor. According to Legal information Institute, â€Å"Trade Secret is defined as the information, including a formula, pattern, compilation, program, device, method, technique, or process that derives independent economic value or potential, from not being generally known to or readily ascertainable through appropriate means by other persons who might obtain economic value from its disclosure or use.† The issue is that Orr and Schutte had an intentional plan to use the operations of Premier Technologies against them to make the organization fall into the red and sale for a price less than what the business is worth. In Bannock County, Idaho’s Sixth Judicial District in December 2011 ruled in favor of Premier Technologies in the lawsuit Premier Technologies v. Chadd Orr, Jeff Schutte and Petersen, Inc. Doug Sayer, also Premier Technology’s president and chief operating officer, argued that Chadd Orr and Jeff Schutte was conspiring with Peterson. This made Orr and Schutte breach their fiduciary duties that they owed to Premier Technology while they were high level managers at Premier Technologies. The jury unanimously voted in favor of Premier Technologies and agreed that both Orr and Schutte violated the Idaho Trade Secret Act, and that they both had a fiduciary relationship with  Premier. The jury also ruled in favor of Premier, implicating Petersen Inc. had, in fact, conspired with Orr and Schutte in breaching of their fiduciary responsibility to Premier Technologies. The ruling awarded a little over two million dollars to Premier Technologies. A $905,250 judgment was set agains t Schutte, while a $603,500 judgment against Orr was set for breaching their fiduciary duties. Punitive damages were awarded as such $172,000 against Schutte and $120,000 against Orr. The analysis of the case appears to be quite simple in nature. The court’s decision ultimately stems from Orr and Schutte’s fiduciary responsibilities that they owed to Premier during their employment with the company. The copy of protected data was not in itself the infraction, but when that information was subsequently provided to a direct competitor, an illegal activity had taken place and the two men were liable for their actions. The state laws of Idaho clearly protected Premier, and any business entity, from this form of intellectual property theft. It also awards that company money to satisfy the damages that were caused by these actions, and because of the intentional nature of the act, punitive damages were made possible as well. As there are often no formal means to protect the trade secrets that a company might have in their processes, litigation is sometimes the best option and, in this case, it certainly provided Premier with the chance to recoup their losses. As a future employee hiring procedure, it might be pertinent for Sayer to include an employee clause that gives up their right to work for a direct competitor in the future, as some highly competitive organizations do (Idaho State Journal). Through many trials and errors, laws have come to pass to protect each business from employees who wish to harm them. Orr and Schutte not only jeopardized Premier Technology’s operation, but they also jeopardized their integrity. Once they decided to work with a competitor, they stole valuable information from the Plaintiff in order to make the business fail. Their actions turned into a lawsuit that determined they breached their contract with Premier Technologies. Due to this infringement, both parties and competitor were liable for all damages incurred to Premier Technologies. Courtly Love in Romeo and juliet Essay

How does Shakespeare show that Romeo’s love for Juliet is real? How do his words and actions differ from when he said he loved Rosaline? In Shakespeare’s play Romeo and Juliet, the introduction of Romeo to the audience is haunted by a melancholic mood. The scene is set in Verona where Romeo’s family is worried about him due to his rejection in love from a woman, Rosaline. However throughout the scenes studied, it seems that love is the primary driving force behind most of Romeo’s actions and words. In general, the theme of love and the course of it intertwine with the fate of the violent peacefulness of this tragedy. His determined desolation from his family stirs unease in his cousin, Benvolio. During the course of this tale, Romeo blooms to become a mature man, who has experienced the double edged blade of love itself. The characterisation of Romeo in the beginning of the play illustrates him as dejected and depressed boy due to his infatuation with Rosaline being rejected. In spite of this, his spoken words of ‘love’ for her, for example: ‘Alas, that Love, whose view is muffled still†¦Ã¢â‚¬â„¢ demonstrates the conventional manner of love that this is. Romeo’s words clarify how he sprouts courtly love poetry, which is machinated and processed. A modern example would be the phrase: ‘roses are red, violets are blue†¦Ã¢â‚¬â„¢ a common phrase which is predictable and an inferior imitation to real love. Courtly love poetry was often used in those days by men with social status to court woman; the purpose behind this courting was to flaunt their skills. Would it be fair to say that Romeo courts for Rosaline’s love because it is the fashion of the season? In Romeo’s first scene, Shakespeare litters the dialogue with negatives, as well as exaggerated words, such as: ‘sad hours seem long†¦Not having†¦short†¦Out of her favour†¦Ã¢â‚¬â„¢ which displays the deep shallowness of his love for Rosaline. Not only Romeo’s word can suggest this, but on the contrary, so do his actions. Leading to the point at which his inexperience and immature manner can be seen. The way in which Shakespeare clutters Romeo speech with riddles may indicate at whether if Romeo’s love or love in general can really be described as brawling and juxtaposed with hate? Shakespeare demonstrates how fickle Romeo really is in the beginning of the play. As known, the words of love from Romeo to Rosaline are all courtly love poetry; fake, clichà ©d and scattered with misrepresented ideas of love. From his initial depression over his rejection of Rosaline’s love, to which he claims an eternity of sadness, to his new professed to Juliet at the Capulet ball. His inconstant change of his receiver of affections hint that his frivolous nature is what defines him. However, his short mourning of Rosaline can suggest of his instant connection with his other half of his soul, Juliet. His halted period of the ‘eternity of sadness’ can only illustrate the strong connection between the two lovers. ‘Love at first sight’ is a familiar phrase to describe how the two fell in love. Could Romeo’s initial fickleness in love demonstrate the vast contrast when he meets Juliet? Romeo soon begins to genuinely fall in love with Juliet as well as idolising her. His first meeting with Juliet at the Capulet ball starts to weave a complicated web of reality, love, fate and death. It is at this moment that Romeo finally grasps/comprehends the true notion of love. His worship and love for Juliet may seem foolish and much like his initial infatuation for Rosaline at the beginning, however it is soon acknowledged that her refusal speaks something differently to him. Shakespeare indicates the sincere affections of Romeo towards Juliet through their dialogue in the balcony scene, Act 2 Scene 2. A strong example of this is in the balcony scene, at which Romeo in his own peril tries to see Juliet. He sets the foundation of this scene when he begins to compare Juliet to all sorts of things of great beauty. He sees Juliet as light and calls her ‘the Sun†¦Ã¢â‚¬â„¢ He claims that even the moon, the traditional symbol for a woman’s beauty and purity, is envious of Juliet. This characterization is not merely dramatic. The use of these superlatives is meant to convey Romeo’s deep feelings. When compared to his earlier characterization of Rosaline, Romeo’s tribute to Juliet takes on even more significance. The difference between what Romeo says of Rosaline and what he says in the â€Å"But soft† speech about Juliet emphasises his adoration even more. His characterization of Rosaline commences with the traditional comparison to Diana. Romeo acknowledges that Rosaline is â€Å"rich in beauty† and that her beauty is defined in terms of her chastity. It’s part of her appeal to Romeo. Romeo values Rosaline because she will not satisfy his desires; therefore, he thinks of her beauty as lost to ‘all posterity’. However, when he describes Juliet and invokes the sun, he suggests something far more potent: the eternal source of light and life-giving force of the heavens. Juliet’s beauty and warmth will live forever and do not depend upon Romeo’s perceptions. She exists independently of Romeo, and when Romeo thinks of Juliet, he dwells on her and not on what she will do for him. Romeo’s language demonstrates that although he was infatuated with Rosaline; he has no mere crush on Juliet. He is deeply in love, and the depth of his feelings demonstrates Romeo’s maturation. His speech is long and full of devotion, to which Juliet replies: ‘O Romeo, Romeo! Wherefore art thou Romeo? (Oh Romeo, why do you have to be a Montague?)’. Her obvious fondness for her is displayed, although at this point Romeo is still sprouting his ‘courting’ words. In the middle of the dialogue, Juliet dares to interrupt Romeo on one of his ramblings as she is sorely frustrated with Romeo’s pretence. As he swears by the moon, Juliet responds by saying: ‘O swear not by the moon, th’inconstant moon. That monthly changes in her circled orb, lest that thy love prove likewise variable.’ Once Romeo is firmly ‘put in his place’ by Juliet by her professing that he speak directly to her and not swear on something that disappears in the day and is ever-changing. In addition, when at first Romeo kisses Juliet at the Capulet ball, she accuses him of kissing by the book (kissing expertly), which is the ‘Hallmark’ love that was shown in the beginning. Shakespeare illustrates to the audience that Romeo and Juliet’s love in genuine through the comparison between his love for Rosaline and then his love for Juliet. As written by Shakespeare, Romeo proclaims to be in an eternity of sadness (darkness), however, he soon meets Juliet who is his ‘sunshine’ in his ‘darkness’. Even though Romeo had been rejected by Rosaline, he never tried to court her again, as if his determination went down the drain. On the other hand with Juliet, Romeo tried again and again to try to win her favour, to the point where he risked talking to her by sneaking into her garden. Although the language from Romeo in both scenes has been passionate, however a powerful example of their fated love is their first dialogue. In the Capulet ball, their first encounter and dialogue encompasses in total 14 lines, more commonly known as a sonnet. Sonnets were often written about love, and using a sonnet in this sense shows how they are two halves of one soul; fated to be with each other, for without one half the other in incomplete. The language used is potent in every sense, personifying Romeo’s words when he talks to Juliet. His determination to win Juliet’s favour demonstrates his true ardour for her, whereas his lust for Rosaline left him desolated and irresolute. All of these factors lead to the one point that Romeo’s love for Juliet is real compared to his infatuation with Rosaline in the beginning. In conclusion, a possible theory as to why Shakespeare shows this contrast in love, could be to illustrate when later in the tragedy, their deaths (suicides) were not foolish but bred of unadulterated and unconditional love. To emphasise that they were truly intertwined with each other as to the fact that they could not be separated, ‘til death do us part. Furthermore, it could also be said that Shakespeare showed this contrast to suggest that in this world there is a difference between lust and love, and the difference covers a broad horizon. Perhaps Shakespeare wanted the audience to comprehend how sweet love can bring the most violent of outcomes and what is commonly read in poems or tales are unrealistic and not a true representative of what love is truly like. Maybe it was Shakespeare’s own way of providing the audience of a ‘reality check’, just as Juliet did with Romeo in the play. Football as an Intramural Essay Abstract Intramural sports present a fun way for students to spend their time at school, and provide an excellent opportunity to introduce themselves in the new world of college. Students get the chance to meet new people by playing against them in various sports such as softball, volleyball, and basketball. These sports are also co-ed, meaning that men and women can play on the same teams or against one another. Intramurals is also a great way to improve attendance or boost student’s motivation to improve their grades. However, there is only a select variety of options for sports. Most of the sports would fall under women’s sports, with their being softball over baseball and volleyball over football. There aren’t many options for men to get involved in intramurals with no men’s sports to play. Adding one sport that’s a men’s sport will give men more options in participating in intramurals. The addition of football may be what this school needs to get more people involved in intramural sports at Alexandria Technical and Community College (ATCC). With a chance for more men to participate, and more women to get involved in men’s sports, it’s a sport that cannot fail if the right conditions are met. Too much contact could be an issue, but if it were even touch football (2-hand touch), there wouldn’t be very many problems. Adding football to ATCC intramurals is what this school needs to not only offer more options for students, but to help attendance and boost student motivation to improve grades. It will be beneficial for the school, and fun for the students. 1. 0 Introduction Alexandria Technical and Community College is a great place to get to know other students. One of the ways to meet the students is by joining their intramural sports and getting on teams that compete against the other teams of the school. 1. 1 Problem With having intramural sports comes the privilege of choosing what you want to do with your time. However, there are not many options for intramural sports. There is softball and volleyball, just to name a couple, but not many options for the students. This may be why there are a lot of ATCC students not participating in intramurals. We believe that the addition of one particular sport will attract more students, and that sport is football. 2. 0 Discussion 2. 1 Benefits to ATCC One of the main focuses of ATCC is to get their students involved in the school and the community. One of the ways they stride for this goal is to encourage students to join in intramurals. Our idea is that if football is added to the intramural list, it may bring in more students to participate in intramural sports, and bring more students together. 2. 2 Benefits to Students According to the National Collegiate Athletic Association (NCAA) Proposition 48, students who participate in school activities and sports must maintain a GPA of 2. 0 on a 4. 0 scale [ (Begnaud, 2007) ]. With that being said, this would prove that students who participate in extracurricular activities would have to motivate themselves and push themselves to maintain a high enough GPA to still participate. This motivation would be beneficial to students, and with more students wanting to play football, this would motivate more students to succeed in school. So now the question is, â€Å"How do you know football is a popular sport? † Well, according to studies done by many colleges such as MSU Moorhead, football has been ranked the number one popular sport in the United States [ (Walter) ]. This means that given the choice, football would be the top pick for the majority of the nation. With that being said, if football is added to intramurals then students would choose it for their intramural and would be motivated to do well in school to be able to participate in intramurals. Figure 1. 1 2. 3 Effects on Attendance As was stated in section 2. 1, students would be more likely to do good in school because they must maintain a GPA of at least a 2. 0 on a 4. 0 scale. If students are to good in school, they must attend school and do well. Attendance is important to do good in school, so intramurals must effect attendance, right? This can be proven if the rules of the NCAA Proposition 48 are followed. 2. 4 Effects on Grades Again, the NCAA Proposition 48 proves that sports do have a major impact on grades, but only because they have to. Students must do good in school if they want to participate in intramurals. Figure 1. 2 2. 5 Right to Give Students a Choice in Sports According to the Constitution, we all have the right to free speech (Amendment 1). If this is true, then it should also give us all the right to a vote. So shouldn’t students be able to vote on whether or not to include football in intramurals? In addition to that, students should also have the right to vote on whether or not to choose if they want to play football as their intramural if it is added to intramurals. The point to be made here is that we all have a right to vote, so we feel that there should be a vote at ATCC on whether or not to add football to the list of intramurals. Our voices should be heard if there is something that we truly believe will benefit the people and the school better. 2. 6 Comparison to Schools with Football as an Intramural Sport It is very difficult to compare ATCC with other schools with intramural sports, and especially since ATCC doesn’t have football as an intramural. However, according to the following website, these are the community colleges that do include football as a sport of choice: http://en. wikipedia. org/wiki/List_of_community_college_football_programs This website gives all of the schools that have football as a sport of choice. On this list, some of the schools are also listed on the list of the top community colleges in the US. ATCC ranked #8 on the list, while St. Paul College ranked #1, and they do have football as a sport [ (Washington Monthly, 2010) ]. So, could football actually help our students do better in school? It appears that it could, since 57% of all men in colleges played football [ (Heinlien, 2007) ]. 3. 0 Conclusion In conclusion, due to the facts given in the above sections, we believe that students should be able to participate in a vote for football as an intramural at ATCC. Also, whether the vote happens or not, football should be added to the intramural list to improve student participation, and to improve not only attendance, but grades too. 4. 0 Appendix 5. 0 Glossary Intramural-involving only students in the same school or college.
